If the maintenance work on the property lasts more than 20 days, tenants are entitled to a discount on the rent to be paid. The rebate is calculated by determining the percentage of the property that cannot be accessed and deducting this percentage of the rent. The short-term condition must be indicated in the contract. Landlords have the right to terminate their lease for the following reasons: If the tenant rents for a period of 3 to 12 months for purposes such as placement or rest and relaxation (not to be confused with vacation), a fixed-term lease should be offered to them – “Contracto de Arrendamiento por Temporada”. – If the tenants do not comply with their contract, the landlord must first require in writing that they comply. The deposit can be increased each time the contract is renewed, but cannot exceed the monthly rent. If the outstanding amount is less than 2,000 euros, the lessor can take legal action to claim it without the right to a lawyer. These are short procedures that last a few weeks, according to which a legal act will be given to execute the claim (execution title). With this title, the owner can easily claim outstanding payments. Short-term leases: short-term or seasonal leases (contracto de arrendamiento de temporada) require the tenant to be obliged to evacuate the property at the end of the contract. This type of contract is usually used for vacation rental and can last up to a year. In Spain, there are two types of rents: short and long term. Short-term rentals are mainly designed for holidaymakers and come with contracts with the phrase “Por Temporada,” which literally means “seasonal.” Long-term leases are called “Vivienda,” which means “home” or “housing” and is intended for those who plan to stay in the country for the long term.
